Orange County Partner Sean Dowsing and Los Angeles Associate Victoria Trepany recently wrote an article, “Defeating Design Professional Liability Claims,” for the Claims and Litigation Management Alliance’s (CLM) Construction Claims magazine. The article discusses an emerging trend of injured workers suing architects and engineers, and argues that design professionals may not owe a “duty of care” to individuals who’ve already recouped their losses under workers’ compensation benefits.
