Glenn M. Johnston is a Partner in the New York office of Manning Kass. He is a member of the Workers' Compensation team.

Mr. Johnston handles matters arising out of workers' compensation for carriers, employers, and third-party administrators covering claimants in New York. He has worked in the area of workers' compensation as both defense counsel and claimant's counsel and has appeared in person and virtually at most of the hearing points in New York. He has handled multiple board appeals, requests for full board review before the New York State Workers' Compensation Board, and appeals to the New York State Supreme Court. He has covered thousands of depositions, and appearances. He has worked on numerous fraud investigations. Additionally, Mr. Johnston has negotiated settlements and stipulations on matters including occupational disease claims, and traumatic injuries and he has also worked on 9/11 cases on both the defense and claimant's side. He has taught webinars in the area of Section 29 of the New York Workers' Compensation Law and Subrogation, and he continues to share knowledge with clients about ongoing changes and development in the New York Workers' Compensation Law area.

Prior to commencing his career as a Workers' Compensation attorney, Mr. Johnston worked for the United States Federal Courts as a training officer for eleven years. His responsibilities included the design, implementation, and maintenance of training programs for members of the bar, court staff, and federal law clerks on two-year clerkships. He has presented at national conferences for the Federal Judiciary on the topic of Intergenerational Communication, and he has presented to the Canadian International Trade Tribunal on the topic of training in the area of Customs and International Trade. During his time with the Courts, he also authored compendiums on Customs and Trade law, as well as desktop automation manuals, and he coordinated the accreditation and compliance of the Court as a provider of Continuing Legal Education before the New York State Board of Continuing Legal Education.

Mr. Johnston received his law degree from Seton Hall University School of Law, where he was a member of the Moot Court Board, the Appellate Advocacy Moot Court Board, the Intellectual Property Law Association and the Entertainment Law Association. He received his Bachelor's Degree in International Politics from the Pennsylvania State University.

In his free time, Mr. Johnston likes to cook, travel, learn foreign languages, play guitar and spend time with his family. He also contributes to his alma mater by coaching Interscholastic Moot Court Board competitors in national competitions. He and his fellow coaches have produced two national championship teams in the area of copyright law, and he has successfully coached teams to semifinalist, and quarterfinalist finishes in the areas of securities law and copyright law. While attending law school, Mr. Johnston was awarded the Best Oralist at the Burton D. Wechsler First Amendment Moot Court Competition at American University Washington School of Law, and as a third-year law student, he placed in the quarterfinals of the Tulane Mardi Gras Invitational Moot Court Competition.

  • Glenn M. Johnston Defeats Fraudulent Workers’ Compensation Claim
    New York Partner Glenn M. Johnston recently obtained a defense verdict in a workers’ compensation case in which the Claimant, an employee of an automotive and clean energy company, submitted a claim for an allegedly new knee injury, as well as an injury to his right hip and lower back. After an initial adverse decision establishing the claim, Mr. Johnston successfully moved to appeal. His appeal was aided by the fact that the Claimant had disclosed an unreported prior knee injury predating the claim by nine months and had reported different events as the basis for his injuries to various medical providers. The Claimant continued to pursue the claim, arguing that his allegedly limited English skills and poor-quality translators were to blame for the discrepancies in his statements to providers. At the final Workers’ Compensation Board hearing, Mr. Johnston provided an outline of the prior incidents of injury recorded in the Claimant’s medical record, as well as evidence that the Claimant had not used the services of a translator at any of his medical visits. He also pointed out that the Claimant, who had been driven by his supervisor to the emergency room at the time of his alleged injury, had checked himself out of the hospital after his supervisor had left and before any diagnostics could be taken. Along with this evidence, Mr. Johnston demonstrated the Claimant’s history of fraudulent activity by providing a prior judgment against the Claimant for social service fraud. His efforts resulted in a defense verdict, with the fraudulent claim being disallowed.  Glenn M. Johnston is a member of the Workers’ Compensation team.
