Defense Victory for Sevan Gobel and Ladell Muhlestein in Wrongful Death Suit

The decedent was hit by a tractor trailer while riding a bicycle across a driveway leading from the defendant’s property. Plaintiffs alleged that the firm’s client was responsible for the unfortunate death their husband/father.

Los Angeles partner Ladell Muhlestein drafted two Demurrers for the case, argued by partner Sevan Gobel. The first Demurrer eliminated seven of the eight causes of action against the firm’s client for wrongful death, negligence per se, and negligent hiring/supervision. The second Demurrer eliminated the remaining cause of action for premises liability and was sustained without leave to amend.

Plaintiffs had demanded a seven-figure settlement.
