Dennis B. Kass and Bailey Sack Examine Third-Party Litigation Funding in New Article

Kass and Los Angeles Associate Bailey Sack composed an article for the International Association of Special Investigation Units’ (IASIU) quarterly publication, SIU Today. Titled “The Hidden Costs of Third-Party Litigation Funding,” the piece analyzes how third-party litigation funding (TPLF) can hinder the fairness of proceedings due to their ability to exert significant control over a case for higher financial gain, often to the detriment of the plaintiff and their needs. Considering the lack of formal regulation or oversight for TPLFs, the article presents practical applications for defense lawyers to ensure transparency of TPLF agreements and protect claims from improper or illicit influences.
Dennis B. Kass is the Chair of the Complex Litigation team. His practice focuses on affirmative litigation lawsuits involving insurance fraud, first and third-party special investigation defense, and high exposure and catastrophic personal injury matters, among other claims. He has received a number of honors for his trial skills, including the California Lawyer Attorney of the Year (CLAY) award, for which he was voted the top litigator in the State. Mr. Kass is also a member of the American Board of Trial Advocates (ABOTA).
Bailey Sack is a member of the Complex Litigation team. Her experience includes high-stakes cases, such as a large-scale public works construction fraud dispute involving multiple Los Angeles County schools, fraudulent billing matters, and bankruptcy fraud disputes.
