Ellrod Featured in Super Lawyers Article on Health Club Contracts

Manning & Kass Founding Partner Tony Ellrod was prominently featured in a recent Super Lawyers article about the importance of following state statutory schemes in health club contracts. Most states have strict regulations regarding what must be included in a health club contract and violating those requirements can result in owners being exposed to greater liability.

From the article:

“’Most gym owners, and many attorneys, don’t even know that these codes exist unless they have counsel, so I see non-conforming contracts all the time,’ Ellrod [said]. ‘Not only are they exposed to class actions for not conforming with the code, if someone is injured in your gym and you try to enforce the contract, a non-conforming release will be seen as void. We address this all the time.’”

The article goes on to review other factors that create more or less exposure to liability for health club owners. The full article can be found here.

Mr. Ellrod presently heads the firm's Business Litigation; Corporate and Commercial Transactions; Intellectual Property; and Sports, Recreation, and Attractions Law Teams. He developed an expertise in sports, recreation, and attractions law early in his career, and is nationally regarded as one of the leading experts in sports and recreation law. He represents many of the largest health club chains and attractions in the country, as well as some of the nation’s largest sports and recreation industry trade groups.
