Garros Chan Delivers Daunting Deposition, Earns Case Dismissal

Congratulations to Los Angeles Associate Garros Chan on earning a victory for the San Bernardino County Sherriff’s Department in a recent shooting case. The case put Mr. Chan's daunting deposition skills on display as he obtained a damaging witness testimonial that pressured the opposing counsel to request a dismissal.  

The case involved a car chase between the subject and deputies from the San Bernardino County Sherriff’s Department. Mr. Chan deposed a key witness who was in the front passenger seat of the subject's car when the subject initiated a high-speed pursuit with deputies. The witness and three other passengers resisted the subject's attempts to give them possession of his gun and urged the subject to let them exit the car.

The subject ignored the passengers’ requests, but the four individuals were able to jump out of the car after it hit a corner and sustained damage. The damage slowed the car down to a maximum speed of approximately 5 to 10 miles per hour, at which time the deputies ordered the subject to stop and show them his hands. The witness then testified that he heard the subject shoot at the deputies, with the first shot distinctly identifiable as the subject's gun by its weak and “dusty” sound.

This critical witness testimony clearly confirmed that the subject shot first at the deputies. The opposing counsel reached out for dismissal after the damaging deposition, followed shortly thereafter by joint stipulation for dismissal of the case with prejudice.
