Karen Liao & Lina Hung Secure Early Dismissal of Premises Liability Claim

Orange County Managing Partner Karen Liao and Los Angeles Associate Lina Hung recently prevailed in a premises liability claim arising out of a trip-and-fall in our retailer client’s parking lot. Our team filed a demurrer and motion to strike, arguing that Plaintiff’s Complaint was barred by the two-year statute of limitations and that she had failed to plead sufficient facts to support an award of punitive damages. During oral argument, Plaintiff attempted to present an additional submission in support of her claim that her Complaint was timely. The Superior Court sustained our demurrer and denied Plaintiff leave to amend her Complaint. The motion to strike was determined moot in light of the Court’s ruling on the demurrer.

Karen Liao is a member of our Business Litigation, Restaurant, Retail, and Hospitality, and Sports, Recreation, and Attractions Law teams. She focuses her practice on the defense of retailers, health clubs, sports clubs, attractions, theaters, and other businesses in matters involving general liability, premises liability, and business litigation. With experience on both sides of litigation practice, Ms. Liao draws upon her diverse legal background to imbue her practice with a unique approach to effective client representation.

Lina Hung is a member of our Appellate Law (Strategy, Writs, & Appeals) team. Before joining the firm, she worked as a mediation specialist and litigation associate in firms in Los Angeles County, where she gained experience in areas such as business litigation, insurance defense, personal injury, and employment law.
