Kathleen A. Hunt and Jeffrey Y. Tsao Earn Summary Judgement

Congratulations to Manning & Kass Partner Kathleen A. Hunt and Associate Jeffrey Y. Tsao on earning a summary judgement for their client in a recent lawsuit. 

In December of 2018, the Plaintiff fell in a large department store while riding an escalator from the second floor to the first floor. The Plaintiff alleged that while on the escalator, it suddenly stopped working, causing her to fall forward and she received several injuries as a result. These injuries required a hospital stay. The Plaintiff brought separate claims of Negligence and Premises Liability against the store.

Ms. Hunt and Mr. Tsao successfully convinced the court that Plaintiff had no evidence about how she fell, or even that her fall was because the escalator malfunctioned in any way. Additionally, inspectors of the escalator by the City of Los Angeles found nothing wrong with it. The court agreed that the Plaintiff’s entire case was based upon speculation and conjecture.
