Kenneth S. Kawabata Obtains Defense Verdict in Personal Injury Case

San Diego Partner Kenneth S. Kawabata prevailed once again in trial by obtaining a defense verdict for our client, a Carlsbad church. The Plaintiff had just finished choir practice in the evening held by our client (Church) when she was struck in the parking lot by a car being operated by another church and choir member. Plaintiff suffered severe injuries resulting in five back surgeries and alleged significant future losses. After settling with the driver, the Plaintiff brought an action against the Church for negligently maintaining an ultrahazardous condition on its property by having an unlit or very dimly lit parking lot. The Plaintiff asked the jury to award $23 million against the Church. Although the jury found the Church negligent, it found there was no causation for Plaintiff's injuries due to any action by the Church which resulted in zero liability on the part of the Church for the millions of dollars in damages sustained by the Plaintiff. 

Mr. Kawabata is a member of the Business Litigation and Employment Law practice groups.
