Ladell Hulet Muhlestein Wins Rare Reversal

In October of 2013, the firm filed suit on behalf of a major insurance company, alleging that a Southern California medical corporation and its owner/doctors had submitted 3.5 million dollars in bills to the insurer in violation of B & P Code Section 17200, through illegal upcoding, unbundling, and other wrongful activities. In May of 2014, the defendants’ demur to the original complaint was granted without leave to amend, because, the trial court stated, the insurer’s payments were made to the patients’ attorneys rather than directly to the patients. Ladell H. Muhlestein, of the firm's Appellate Law Team, filed an appeal challenging the lower court's decision, and recently obtained a rare reversal of the trial court’s order. This victory enables the firm's client to proceed to make its case.
