Manning & Kass Strategy, Writs and Appeals Team Obtains its Third Appellate Stay in Ten Months

On Monday, May 16, 2016, the Strategy, Writs and Appeals Team—nicknamed “SWAT"—at Manning & Kass obtained its third appellate stay in ten months. In each case, a California or federal appellate court issued orders within a matter of hours, preventing a trial court from releasing confidential information. Even more astonishing, each brief was written by a different SWAT attorney and involved a different area of the law:

  • The most recent win came when the Fourth District, Division Two issued a stay order precluding a trial court from releasing confidential information regarding law enforcement officers which was sought by a criminal defendant. [City of Colton v. Superior Court, Court of Appeal Case No. E066021, represented by Mae Alberto, a Los Angeles associate.]
  • Earlier this year, the Court of Appeal issued a stay order preventing a court from ordering a good faith determination, which would have effectively cut off all cross-complaints. [Southern California Fleet Services v. Superior Court, Court of Appeal Case No. E065134, represented by Steve Pyun, a Los Angeles associate.]
  • In July of 2015, the Ninth Circuit issued a stay order preventing a trial court from releasing a confidential video of an officer-related shooting. [Mendez v. Gardena, Ninth Circuit Case No. 15-56090, represented by Scott Wm. Davenport, a Los Angeles partner and the team's practice area leader.]
