Motion for Summary Judgment Granted Despite Challenges

In a team effort, Manning & Kass partners Sevan Gobel and Ladell Muhlestein and associate Orchid Barzin successfully litigated and ultimately prevailed on a Motion for Summary Judgment in a case involving assault and battery claims against a firm client and its loss prevention agents. Plaintiff's attorney alleged that as a result of the wrongful/forceful detention of plaintiff and failure to timely call 911 plaintiff went into cardiac arrest that culminated in a coma that left plaintiff in a vegetative state. Despite the fact that the surveillance camera angle which would have shown the plaintiff shoplifting prior to detainment was out of order and the plaintiff’s serious injuries, the Court was persuaded to grant the motion.
