Los Angeles Associate Emily Edwards was recently quoted by WorkCompCentral for an article titled “Defense Attorneys Talk Work-From-Home Injuries, Other Topics at WCI Conference.” The article discusses how work injuries differ from case to case and state to state, and whether the injury is compensable.

Ever since COVID-19 forced employers to move their operations partially or completely to remote settings, there has been an expectation amongst workers’ comp attorneys to see more injury claims from employees while working from home. Ms. Edwards said employers can prepare for these claims by ensuring strict, enumerated guidelines that spell out exactly what constitutes an appropriate work environment. The employers can use these guidelines to “establish that it was their misconduct that led to their injury and not the work and scope of the employment,” said Ms. Edwards.
