Jamie Burke and Roya Fohrer Achieve Full Recovery in Breach of Contract Case

New York Partner Jamie N. Burke and Los Angeles Partner Roya H. Fohrer successfully led a breach of contract case to resolution in arbitration. Our client, a think tank addressing youth homelessness, filed a claim when respondent failed to meet its payment obligations for our client’s consulting services. Mid-arbitration, Ms. Burke leveraged the contractual late fee (3% monthly interest with an 18% annual cap) instead of the statutory interest (9%), increasing our client’s total recovery. The arbitrator ultimately issued a final award in our client’s favor and rejected respondent’s efforts to challenge the interest rate, which were made irrelevant by Ms. Burke’s strategic tactic.

Jamie N. Burke is a member of the Insurance Coverage / Bad Faith team. She has a long track record of successfully representing insurance underwriters, mortgage loan servicers, and other financial institutions in commercial, consumer, real estate, and insurance coverage matters. Before joining Manning Kass, Ms. Burke worked as a commercial litigation attorney at multiple mid-sized law firms in New York, New York, where she represented clients in state and federal courts, in practice areas including complex commercial real estate and business disputes, debtor-creditor law, and bankruptcy. She also served as Vice President and in-house counsel of a Fortune 500 insurance company.
