Appellate Law Team Prevails: Defense Verdict Upheld in Employment Law Case

San Francisco Partner Mark R. Wilson successfully defended an Employment Law case that was taken to the California Court of Appeal, Second District. The plaintiff and appellant sued our client, a health care company, for disability-related causes of action under the Fair Employment and Housing Act (FEHA) after he was terminated for failure to return to work following the expiration of his approved medical leave. San Diego Managing Partner Alfred M. De La Cruz took the case to trial, and the Court ruled in favor of our client based on the jury’s factual findings. Plaintiff susbequently appealed, arguing that he was entitled to a new trial due to inconsistent factual findings by the jury.
