Manning & Kass Celebrates Big Class Action Win for Retailers Everywhere

Los Angeles partners Jeffrey M. Lenkov, Kathleen A. Hunt and Sharon S. Jeffrey obtained a dismissal of a major class action this week.

A disability access class action lawsuit was filed against a national retail chain/Fortune 500 company alleging that their point-of-sale devices are not accessible to disabled individuals in violation of the Americans with Disabilities Act (ADA).

The damages sought in this proposed class action were significant. Plaintiff was initially seeking eight figures including statutory penalties and attorney’s fees.

The litigators, led by Mr. Lenkov, thoroughly investigated all claims and aggressively defended the matter, resulting in a dismissal of the lawsuit for no payment and no modifications.
