Workers’ Compensation Team Earns Defense Verdict On Several Claims

Manning Kass earned a defense verdict on several workers’ compensation claims for our client. The case involved six years of litigation over several claims and multiple trial dates. The initial case revolved around an incident in a workplace in 2014.

The plaintiff sustained an injury while working as a caregiver in 2014 to his lumbar spine, cervical spine, and bilateral shoulders. The plaintiff and his employer entered into a Stipulations with Request for Award settlement which was filed in November 2016. 

The plaintiff subsequently filed several claims regarding additional workplace injuries occurring between 2016 and 2018. These claims led to additional trial dates and medical discovery time allotment. Additionally, the plaintiff sought to reopen his previously settled claim. The plaintiff demanded $70 trillion in damages and medical expenses.

The Manning Kass team, led by San Diego Partner Jason J. Doshi, was able to prove that many of the plaintiff’s claims occurred after they were no longer working for the employer in the original claim. This rendered many of the plaintiff’s claims moot. After years of litigation, the judge ruled that the plaintiff shall take nothing on his subsequently filed claims.
