Richard G. Garcia is a Partner in the San Francisco office of Manning Kass. He is the leader of the Product Liability team, and a member of the Business Litigation, Catastrophic Liability Defense, Class Action and Mass Torts, Governmental Entity Liability, Special Investigations Unit / Insurance Fraud Litigation, and Trucking and Transportation teams.

As leader of the Products Liability team, Mr. Garcia handles cases for clients in different jurisdictions concerning manufacturing and design defects allegations along with failure to warn claims. He also oversees and manages a team of attorneys throughout the firm handling products liability cases. 

As part of the Complex Litigation team, Mr. Garcia focuses on commercial business litigation, affirmative litigation cases involving insurance fraud, high exposure and catastrophic personal injury matters, transportation litigation, and mass torts.

He has represented clients in state and federal courts and has handled complex cases pro hac vice in jurisdictions outside California. He has handled all aspects of litigation, obtained numerous summary judgments and dismissals through dispositive motions, and is a successful first-chair trial attorney.

Mr. Garcia is also a member of the Governmental Entity Liability team representing government entities and their employees in cases involving police excessive force, contract disputes, torts, and construction defect.

On commercial business litigation matters, Mr. Garcia represents corporations in class action defense, breach of contract cases, business torts, malicious prosecution, trademark, anti-trust, employment, and shareholder derivative lawsuits.

Mr. Garcia also specializes in evaluating and prosecuting fraud claims brought under Insurance Code Section 1871.7, Penal Code Sections 549 and 550, and Business and Professions Code Section 17200. This includes actions involving the corporate practice of medicine, the submission of fraudulent claims for services not rendered, the improper use of CPT codes (upcoding and unbundling), capping, and fee splitting. He has successfully litigated cases against medical providers, doctors, chiropractors, attorneys, organized crime members, body shop owners, and stagers who committed fraud in order to enhance their profits. Mr. Garcia has recovered millions of dollars in savings for clients.

Mr. Garcia also handles first and third-party special investigation defense and advises clients on complex insurance claims. He is also a member of the Northern California Fraud Investigators Association.

Mr. Garcia regularly lectures across the country and trains professionals in a variety of subject areas involving insurance fraud defense and affirmative litigation issues. He has written articles and provided training to clients on civil litigation and first-party insurance claims.

Mr. Garcia graduated from the University of California, Berkeley, where he was on the Dean's List and was a recipient of the University of California Alumni Association scholarship. He obtained his Juris Doctor from the University of California, Hastings College of Law. In law school, he interned with the San Francisco City Attorney’s Office’s Constitutional Law team. Mr. Garcia is a graduate of the American Board of Trial Advocates (ABOTA) Trial School Program. Mr. Garcia is a member of the California State Bar and admitted to practice in the U.S. District Court in the Northern District, Eastern District, and Central District of California.
