Sean Dowsing and Victoria Trepany Discuss Defense Strategies in Construction Claims Magazine

Orange County Partner Sean Dowsing and Los Angeles Associate Victoria Trepany recently wrote an article, “Defeating Design Professional Liability Claims,” for the Claims and Litigation Management Alliance’s (CLM) Construction Claims magazine. The article discusses an emerging trend of injured workers suing architects and engineers, and argues that design professionals may not owe a “duty of care” to individuals who’ve already recouped their losses under workers’ compensation benefits. It provides insight into evolving case law and how attorneys can leverage the workers’ compensation system to defeat design professional liability claims for injuries. 

Sean Dowsing is the leader of the Construction Law and Subrogation and Recovery teams, and a member of the Land Use, Parachute Trial, and Professional Liability teams. He is a certified Design-Build Institute of America professional, and his litigation practice includes defects, breach of contract, changed conditions, delays, subrogation, and professional liability. He also represents employers in Cal/OSHA investigations and proceedings.

Victoria Trepany is a member of the Insurance Coverage / Bad Faith team. She has extensive civil litigation experience in federal court, and she has assisted clients within a multitude of practice areas including civil rights, wrongful death, personal injury, negligence, and employment law.
