David V. Roth is a Partner in the San Francisco office of Manning Kass. He is a member of the Business Litigation, Premises Liability, Product Liability, and Retail, Restaurant, and Hospitality Litigation teams.

Mr. Roth leads the General Litigation team in Northern California. His practice is focused on the retail, restaurant, and hospitality industry. Mr. Roth is often sought out as the go-to guy in an emergency when a client’s name, reputation, and business is at risk in media-exposed situations and litigation. Mr. Roth has been called in to protect his client’s interests in numerous nationally covered cases involving premises liability, third-party criminal acts, wrongful death claims, food-borne illnesses, and product liability allegations. 

Mr. Roth currently represents and advises several Fortune 500 companies in the retail, restaurant, amusement park, and entertainment industries. He represents these clients in a wide range of matters including personal and catastrophic injury cases involving premises liability, product liability and third-party criminal acts. In addition, Mr. Roth represents his clients in contract claims, employment actions, class action matters (employment and consumer claims), catastrophic fire loss subrogation matters, and complex ADA claims.  

Mr. Roth brings a unique approach to litigation which includes professionalism, integrity, and a willingness to fight for his client’s rights and reputation through trial. His unique approach comes from understanding both sides of the aisle. Prior to joining Manning Kass, Mr. Roth was the founding partner of a boutique litigation firm that comprised partners from other AmLaw 100 firms and represented corporations and individuals in high-stakes business litigation and catastrophic injury cases, obtaining both defense verdicts and multi-million dollar settlements on behalf of his clients. He is often recognized by both sides of the bar as a trustworthy but tough no-nonsense litigator and trial attorney. 

Mr. Roth has tried to verdict numerous catastrophic injury and wrongful death cases in many of the counties throughout Central and Northern California and has several defense verdicts in both San Francisco and Alameda counties. He is admitted to practice before all courts in the State of California, and has the distinct honor of admission to the United States Supreme Court. Mr. Roth is also admitted to and has significant experience in the United States District Courts and Bankruptcy Courts for the Northern, Southern, Central and Eastern Districts of California; and has been admitted pro hac vice in the District Courts of Maui and Hawai’i for the State of Hawaii. Mr. Roth is a recognized 2015–2017 Super Lawyer. 

Mr. Roth graduated from Golden Gate University School of Law (Juris Doctor) and University of California at Santa Cruz (Bachelor of Arts). He serves as a mentor and volunteer trial judge for Golden Gate University School of Law’s nationally recognized Mock Trial program and the school’s Appellate Advocacy program.
